Police clears, No legal significance for Chief Minister Shivraj Singh Chauhan's statement on SC-ST Act.

OCT 05 (WTN) – Once again Chief Minister Shivraj Singh Chauhan has been ‘embarrassed’ on his statement on the SC-ST Act given in Balaghat district. You will remember that Chief Minister Shivraj Singh Chauhan had given a statement in Balaghat district a few days ago that in Madhya Pradesh, there will be no arrests in the SC-ST act without investigation. After which BJP supporters, on social media, had started campaigning that in Madhya Pradesh, there will be arresting only after investigation in the SC-ST Act.

After this statement of Chief Minister Shivraj Singh Chauhan, a discussion had began everywhere, whether the state government has any right to amend any law made by the Center? Is there any legal basis for the statement given by Shivraj Singh Chauhan? Between all these discussions, the situation has been cleared in this entire case in the Gwalior bench of Madhya Pradesh High Court. The statement of Chief Minister Shivraj Singh Chauhan has made clear by the police in the single bench of the High Court.

In this case, Shivpuri Superintendent of Police has said in the affidavit. “There is no administrative order regarding the investigation before the arresting in the SC-ST Act.” Not only this, it has been said in the affidavit; “There is no legal significance for Chief Minister Shivraj Singh Chauhan's statement in this matter. According to the provisions of the SC-ST Act amended by the Center, any accused will be arrested and action will be taken.”

In this case, the addition advocate general to the Madhya Pradesh government Vishal Mishra and the government advocate sought time from the court saying that they have to take necessary guideline from government and want to present a new response. The court has now asked the government to answer the statement of the Chief Minister. The matter will again be heard on October 11.

For your information let you know that what exactly is the whole case? An advance bail petition in the Madhya Pradesh High Court, filed by Atander Singh Rawat, working in the Health Department, under the teasing and Atrocity Act. In this case, the petitioner's advocate had argued that Chief Minister Shivraj Singh Chauhan had given a statement about the Atrocity Act in Balaghat district that there would be no arresting in the SC-ST Act without investigation. The advocate said that the statement of the Chief Minister was published in the newspapers, but even then the police still wanted to arrest the accused, while the whole case is false.

After hearing the arguments of the lawyer of the prosecution, the court asked for a reply on October 1 whether CM has made such a statement and officers of the superintendent of police rank should present affidavit in this matter and explain their position in relation to the act. While clarifying the entire situation in this case, the SP of Shivpuri submitted his affidavit and made it clear that the statement given by the Chief Minister has no legal significance.

So, by the affidavit of SP of Shivpuri in the High Court has become clear that the statement which was given by Chief Minister Shivraj Singh Chauhan, has no legal significance. The Congress has been calling Chief Minister Shivraj Singh Chauhan for a long time 'minister of proclamation'. In such a situation, while there is no legal basis for the statement given in the Atrocity Act by Chief Minister Shivraj Singh Chauhan, then Congress will not be far off from targeting on Shivraj Singh Chauhan.

But the big question is that why Shivraj Singh Chauhan finally gave such a statement? Shivraj Singh Chauhan had been a Member of Parliament for many years and he has been Chief Minister of Madhya Pradesh for more than 10 years, in such a situation he has a longstanding experience of Parliament and Assembly. Being an experienced politician, the statement given by Chief Minister Shivraj Singh in the matter of law of the Center was very much discussed.

It is being said that Chief Minister Shivraj Singh Chauhan had given such statement to calm the agitation against the amendment in the SC-ST Act, so that the movement could be slowed for some time. According to sources, there was pressure from the Center on Chief Minister Shivraj Singh Chauhan to calm the aggravating movement being held against the amendment in the SC-ST Act. Chief Minister Shivraj Singh himself is so sensible and he knows that how much power the state has to intervene in any law made by Parliament. Now it is to see what reaction Chief Minister Shivraj Singh Chauhan will give in this whole matter.
