Discussion on Supreme Court decisions on 'sensitive' issues like adultery and Sabarimala temple

JAN 02 (WTN) - In the year 2018 many historical decisions of the Supreme Court remained the subject of discussion in the country. What are these important judgments of the Supreme Court? Let’s know.

Decision on homosexuality
In one of its important decisions in year 2018, the Supreme Court had excluded homosexuality from the category of crime. The Supreme Court said in its decision that it will not be considered a crime if the homosexuality is on consent. In its decision, the court canceled section 377 of the IPC. For your information, let you know that under section 377 of the IPC, if two people had made a homosexual relationship with consent or non consent, then it was considered a crime.

Historic Decision on Adultery
The Supreme Court declared Section 497 (Adultery) of the IPC in 2018 as unconstitutional. In this case, the court said that section 497 of the IPC is against the honor of woman and husband can never be the owner of the wife. After this historic decision of the Supreme Court, after the marriage, physical relations with someone else other than husband will not be under the category of crime.

In its judgment, the Supreme Court said that both husband and wife have equal rights on their relations outside of marriage. Sexual intercourse with a married woman by a man is not a crime. For your information, let you know that in this section of the IPC, there was a provision of punishment for the man who had a physical relationship with another man's wife after marriage, but women were exempted from the crime. 

Case of Delhi Government and Lt. Governor
While adjudicating the ‘war’ between Delhi Government and the Lieutenant Governor of Delhi, the Supreme Court said, "The Lieutenant Governor of Delhi is bound to accept the ‘help’ and ‘advice’ of the constitutionally elected government. The real powers of governance are with elected representatives and their views and decisions should be respected."

In this case, the Supreme Court said that the Lt. Governor is bound to take advice and assistance from the Council of Ministers in all other matters, except land, police, public peace and disagreement in cases where he sends the cases to the President.

Decision on the Aadhaar
The Supreme Court, in its one important decision this year, is considered Aadhaar as constitutionally valid. In its decision, the Supreme Court said, "It is not necessary to link Aadhaar with a mobile number and bank account. It is important to add the Aadhaar to the PAN card. Private companies can’t seek the Aadhaar for identifying anyone. Schools can’t even ask the Aadhaar card for admission; they have to give admission on the basis of other documents. The Aadhaar is not mandatory for examinations like CBSE, NEET and UGC. Small children will not be deprived of facilities if they don’t have Aadhaar cards."

Permission for entry of women of all ages in Sabarimala temple
In the year 2018, a historic judgment of the Supreme Court approved the entry of all aged women in Sabarimala temple of Kerala. In this case, the court said, "It is a violation of the fundamental and constitutional rights of women not to enter into the temple." The court has allowed women of every age of 10 to 50 years to enter into the temple.
