Fines for smoking in the public places to increase in COTPA Act
Be ready to pay more fine on smoking on the public place
JULY 24 (WTN) - If you have a habit of smoking in public places, then this news is a warning to you. According to the information received from the media, smoking in public places can now be costly, because the amount of penalty on smoking in public places can increase soon. According to the information, the Government is preparing for change in COTPA (Cigarettes and Other Tobacco Products Act) Act. By making a change in this act, the Government can increase the penalty amount from Rs 200 to more than Rs 1,000 in case of smoking in public places.
The Central Government is also going to make many other changes in the COTPA Act. Like now, there will be huge fine for selling tobacco products to a minor. At the same time, one will have to pay more penalties on selling tobacco products near educational institutions. For your information, let you know that tobacco products can’t be sold up to 100 meters from educational institutions like schools and colleges. If you are doing this, there is a provision of penalties.
In the last financial year, the Government had amassed around 5 crore rupees from the fine under the COTPA Act. For your information, let you know that Tamil Nadu is at the forefront in recovering the fine under the COTPA Act. At the same time, in the case of recovering the fine under this Act, Gujarat is in second place. Talk about Bihar, very few fines have been recovered under the COTPA Act from this state.
For your information, let you know that the Indian Parliament has enacted the Cigarettes and Other Tobacco Products Act in 2003. The Act provides for regulation of trade and commerce in the production, supply, advertisement and distribution of cigarettes and other tobacco products. This Act was enacted by the Indian Parliament to affect the resolution passed by the 39th World Health Assembly. In this act, measures have been taken to protect non-smokers from involuntary risk of tobacco smoke.
The COTPA Act has been implemented in lieu of The Cigarette (Regulation of Production, Supply and Distribution) Act, 1975 [11]. In this Act, advertising of tobacco products other than smoking in public places has also been banned. Any person, who advertises tobacco products, can be punished with imprisonment or fine for two years if he is found guilty for the first time.
As you know, smoking is restricted in public places. The Government intends that strict provisions have to be made to discourage those who do so. It has been observed that those who do not smoke have to face cigarettes and bidi’s smoke due to smokers. In such a case, the Government argues that due to the increase of the penalty, smokers will not do smoking in the public places due to fear. The Government's intention is good, but the big question is, those who are responsible for making fine on smokers, are they doing their duty honestly?
