Four judges of five support women's entry in Sabarimala temple; Women Judge Indu Malhotra protestes

SEP 28 (WTN) - The Supreme Court, today, has terminated the restrictions on women's entry in the Sabarimala temple in Kerala, in one of its historic decisions. In the country's biggest court, the panel of five judges declared their decision in favor of women with a 4-1 vote. For your information let you know that in this 800 years old temple, this belief had been going on for a long time that women of certain age aren’t allowed to enter in the temple.

Chief Justice Dipak Misra, Justice Chandrachud, Justice Nariman, Justice Khanvilkar gave a verdict in favor of women. While Justice Indu Malhotra declared her verdict in favor Sabarimala temple. Reading the decision, Chief Justice Dipak Misra said, "Sex difference can’t be allowed to follow the faith. The work of law and society is to look at all equally. The double standard for women diminishes their honor." The Chief Justice further said, “Lord Ayyappa's devotees can’t be divided.”

In its decision, the Supreme Court said, "As per Article 25, all are equal. It is important to see a change in the society, the dignity of personality is different, but the restrictions on the women were treated as weak in past."

At the same time Justice Nariman read out his decision and said, "Assessing women compared to anyone is a violation of the constitution.”

Justice Chandchud said in his judgment, "It is 'derogatory' for them to stop women from entering in the temple only on the basis that they are in a state of reproduction.” He further said, "To keep women, age group of 10 to 50, out of the temple is to deny their dignity."

Here, Justice Indu Malhotra read out the matter in favor of Sabarimala Temple on this matter. She said, "Religious beliefs can’t be measured on the basis of Article 14." Justice Malhotra further said, "The matter related to faith should be decided only by society, not by the court. Sabrimalana Shrine has the right under Article 25, so the court can’t interfere in these matters. Religious beliefs are also part of basic rights."

After the Supreme Court's verdict, the petitioners on behalf of Sabarimala temple have said that they would file review petitions on it.

For your information let you know that the Sabarimala temple management situated on the hill of the Western Ghats in Kerala's Pattanamthitta district had been banned the women, age group of 10 to 50, entering in the temple because of the menstruation, because they can’t maintain purity.

The Sabarimala temple administration in the case of entry of women in the temple said, “Lord Ayyappa, who is sitting in the temple, is considered as ‘Brahmachari’, therefore, such a rule has been made that women don’t enter there. This is not a matter of discrimination with women.”

Talk to the Kerala government, so on November 7, 2016, the LDF ruled Kerala government had informed the court that it was in favor of entry of women of all age groups in the historic Sabarimala temple. The LDF government of the state had advised the entry of women in the temple in 2007, later, which was replaced by the Congress-led UDF government.

In this case, the UDF government said, “They are in favor of barring entry of women from 10 to 50 years, because this has been tradition since ancient times.” But later the Kerala government agreed to enter of women into the temple once again while keeping its stand in the Supreme Court.

During the hearing, the Chief priest's counsel said, "There must be clarity on the fact that there is no discrimination due to refusing to come to the women of a particular age group. Secondly, in the Hindu religion, the statue established in the temple has a different status, every God has its own distinctive character, when the law of India gives him status as a living person, then he has the fundamental rights too. He has right to be ‘Brahamachari’ and he too has the fundamental right to privacy."

As per the Supreme Court decision, all age women can enter into the Sabarimala temple. After the permission granted what step is to be taken by the Sabharimala temple management. Management says that the tradition of entry of women in the temple is old. In this case, it is a religious tradition that should be followed. Now, while the court says, according to the law, women have the same rights as men to go into the temple, the religious tradition of Sabarimala temple says that women of 10 to 50 years of age are not allowed to go to the temple. It is necessary to see who wins in the end of this war of law and religious tradition.
