According to the information received from the media, in view of the security of the country and to prevent untoward incidents happening in the country, the Modi government is soon going to enact a law that any authorized officer can tap anyone's phone in view of national security. To give such powers to a competent officer, the Department of Telecommunications is preparing to add section 419B to the Telegraph Act. Under Section 419A of the Telegraph Act, phone tapping can be done only with the approval of the Union Home Secretary and the Home Secretary of the States.
The draft of the rules has been prepared by the Department of Telecommunications to add section 419B to the Telegraph Act and will be implemented after getting the approval from the Ministry of Home Affairs. Retired officials of the Intelligence Department and the police say that if the Modi government is making changes in the law related to phone tapping, then this is a good move. Indeed, the system of phone tapping currently in place is quite complicated and lengthy, and for this reason many times it takes time for phone tapping in cases involving national security. Therefore, it is the effort of the Modi government that in order to enable phone tapping as soon as possible for national security, a change in the current system is necessary.
According to the necessary changes that are being made for the phone tapping, any authorized officer, other than the Union Home Secretary and the Home Secretary of the States, can now get the phone tamped when needed. At the same time, the authorized officer will be able to store the message of anyone in view of the licensing conditions of telecom.
