SC / ST allowed benefits of reservation only in one state: Supreme Court

Supreme Court today stated that members of scheduled caste and tribal communities of one state can not claim the benefits of reservation in government jobs in other states if their caste is not notified as SC / ST. In a decision of consensus, a five-member Constitution Bench headed by Justice Ranjan Gogoi said that no member of a Scheduled Caste can be considered in the other states as belonging to Scheduled Caste in any other state where it was intended for employment or education. Other members of the Constitution Bench include Justice NV Raman, Justice R Bhanumati, Justice M. Shantangoudar and Justice S. Abdul Nazir is included.
The Constitution Bench said, "In a state, the person notified as a Scheduled Caste can not claim the same status in another state on the basis of being notified as a scheduled caste in a state." Justice Bhanumati, however, regarding the implementation of the Central Reservation Policy, regarding the SCA, expressed dissatisfaction with the majority view. In the verdict of the majority of 4: 1, the bench said that as far as Delhi is concerned, the central reservation policy regarding SC / ST will be implemented here.
The Constitution bench awarded this decision on the petitions in which the question was raised whether in a state the person notified as SC / ST can get reservation in another state where his caste has not been notified as SC / ST is. The bench also questioned whether the SC / ST members of the other state can get the benefit of reservation for jobs in Delhi.
