There will be provisions in the ordinance which are in the bill passed by the proposed legislation and the Lok Sabha. Triple Talaq will be non-bailable offense, and the convicted person will be sentenced to imprisonment upto three years. Crime will be non-bailable and cognizable. Apart from this, a woman suffering from triple talaq can demand the custody of alimony and minor children in a magistrate's court. Significantly, the bill has been stuck in the Rajya Sabha by taking a U-Turn of Congress and opposition parties. The bill was not passed in the winter session.

After the cabinet decision, Union Law Minister Ravi Shankar Prasad said that there are 430 cases of three divorces before us, of which 229 are before the Supreme Court judgment and 201 are after the Supreme Court verdict. We also have strong evidence of three divorce cases. The majority of these cases (120) are from Uttar Pradesh. Taking the Congress aside, he said that we tried to get it passed again and again. Some 5 times tried to convince the Congress but in the wake of vote bank, the Congress has not allowed it to pass.
