Adultery, Not a crime, SC struck down IPC section 497

On the issue of adultery, the Supreme Court today clearly said that husband's have no proprietary right on her wife. Apex court also struck down IPC section 497, the court said that extramarital affairs are not a crime. Chief justice Deepak Mishra said that quality of democracy includes concept of I, you and we." He said that women should always be respected. Mishra said that the dignity of women is highest. The behaviour of disrespect with women is unconstitutional. Conduct against women's honour is wrong and every man should understand this. Bench of the five judges headed by Chief Justice of the Supreme Court, Deepak Mishra, Justice R.F. Nariman, Justice D.Y. Chandrachud, Justice Indu Malhotra and Justice A.M. Khanvilkar passed the historical verdicct.
The central government has already filed its affidavit in this case. The Constitution Bench of the Supreme Court has passed this ruling on Section 497 of the Indian Penal Code (IPC) related to extramarital affairs of the man and woman.
A non-resident Indian Joseph Joseph Sain filed a petition in this regard challenging the constitutionalism of the IPC Section 497. The court heard on the matter that adultery comes into the category of crime or not. In this case the court had reserved its decision on August 8.
